Terms of service
These terms explain the agreement between you and DaisyBee Arts when you buy a print from this shop or commission a painting. They set out what you can expect from me and what I need from you.
I've tried to write them in plain English rather than legal jargon. If anything is unclear, email me at daisybeearts@gmail.com and I'll explain it.
Please read them before you place an order. By placing an order, you're agreeing to them.
Who you're buying from
DaisyBee Arts is the trading name of Daisy Banks, a sole trader based in Aberdeen.

The shop runs on Shopify, but your purchase is with me, not with Shopify.
What I sell
Prints. Unframed prints of my own ink and watercolour paintings, in A5, A4 or A3. Not every painting comes in every size; the sizes for each one are shown on its page.
Commissions. A painting of a place or a pet that matters to you, painted by hand in A5, A4 or A3. How commissions work is set out below.
Using this website
You need to be at least 18 to place an order.
You can check out as a guest, or sign in with your email address to see your past orders and saved addresses. Please make sure the details you give at checkout are accurate, especially your delivery address and email.
About the artwork
Every painting is made by hand. Prints are reproductions of those paintings, and I photograph and print them as faithfully as I can, but colours can look a little different on your screen than they do in person, depending on your device. That isn't a fault.
Each commission is painted once, for you, so small variations in brushwork, texture and colour are part of the work.
Placing an order
When you place an order, you're offering to buy. The contract between us starts when I send you an email confirming your order.
Very occasionally I may not be able to accept an order, for example if there's been a pricing mistake or I can't post to your address. If that happens, I'll email you and refund you in full.
Prices and payment
Prices are in pounds sterling. I'm not VAT registered, so there's no VAT to add. Postage is shown separately at checkout before you pay, and is set out on my Shipping Policy page.
Payment is taken when you order. Payments are handled securely by Shopify's payment providers, and I never see your full card details.
If something is shown at an obviously wrong price because of a genuine mistake, I don't have to sell it at that price. I'll contact you and let you choose between paying the right price or cancelling for a full refund.
Discount codes
Signing up to my emails gets you a code for 10% off your first order. Codes can be used once per customer, only one code can be used on an order, and codes can't be combined with other discounts or exchanged for cash.
Delivery
Delivery times are estimates, not guarantees. Postal delays do happen, especially in December. Unless we agree otherwise, I'll deliver your order within 30 days.
Your order stays my responsibility until it reaches you. If a parcel is lost or damaged on the way, that's mine to sort out, not yours. The full details are on my Shipping Policy page.
Returns and refunds
You can cancel an order for prints within 14 days of it arriving. Commissions are painted for you and work differently. Everything is set out on my Returns & Refunds page, which forms part of these terms.
Commissions
Enquiry first. Tell me what you'd like painted using the form on my Commissions page. I'll get back to you by email or phone to talk it through and collect your photos. Nothing is paid at this stage.
Agreeing the brief. Together we'll agree the subject, the size and any details that matter to you. Please only send photos you have the right to share.
Prices. A5 £55, A4 £75 and A3 £95, for one place or one pet. Each extra pet in the same painting is £10. Anything larger or unusual I'll quote for separately before you pay.
Payment. Once we're both happy, I'll send you a link to pay. Commissions are paid in full before I start painting.
Timescales. I'll give you an idea of when it will be ready when we agree the brief. Handmade work is hard to time exactly, so treat this as an estimate. If something delays me significantly, I'll tell you as soon as I know.
Seeing it before it's sent. I'll show you the finished painting before I post it. This is the time to raise anything, while changes are still possible.
Changes after I've started. Small adjustments are usually fine. If you'd like a big change to what we agreed once I've started, I may need to charge for the extra time, or I may not be able to do it. I'll always tell you the cost first.
If you cancel. Because a commission is made to your own brief, it can't be cancelled under the 14-day right that applies to prints. If you cancel before I've started painting, you'll get a full refund. If I've already started, I'll keep a fair amount for the work done so far and refund the rest.
If I can't finish it. If something stops me from finishing your commission, I'll refund you in full.
If you're unhappy with the finished piece. This is covered on my Returns & Refunds page. Your legal rights for faulty or misdescribed goods always apply.
Copyright in my artwork
I keep the copyright in everything I paint, including commissions. This is normal for artists.
When you buy a commission, you own that painting. You can hang it, give it as a gift, or sell it on privately. When you buy a print, you're buying it for your own personal use. In either case, you don't get the copyright.
Please don't reproduce, scan, print or sell copies of my work, or use it commercially, without asking me first. Photographing your own piece to share with friends or on your own social media is absolutely fine, and always lovely to see.
I won't share your commission or your photos publicly without asking you first and getting a clear yes.
Reviews
If you leave a review, I may show it on this website and on my social media, with the name you gave. Please only send reviews that are your own and are honest, fair and not offensive. I may choose not to publish a review, and I'll take yours down if you ask.
Using the site properly
Please use this website lawfully. Don't try to interfere with its security, introduce malicious code, scrape or harvest data, or use it to send spam or pretend to be someone else.
Other websites
The site links to my Instagram, Facebook and TikTok and to a few other websites. I'm not responsible for their content or how they handle your information, so please check their own terms and privacy policies.
Privacy
How I look after your personal information is set out in my Privacy Policy.
What I am and am not responsible for
I'm responsible for supplying prints and paintings that match their description, are of satisfactory quality and are fit for purpose, and for getting them to you safely.
If I don't meet those obligations, I'm responsible for loss or damage you suffer that was a foreseeable result. I'm not responsible for loss that wasn't foreseeable, or for business losses such as lost profits, because everything I sell is for personal use.
Nothing in these terms limits my responsibility for:
- death or personal injury caused by my negligence
- fraud or fraudulent misrepresentation
- your rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013
- anything else the law doesn't allow me to exclude
Nothing in these terms takes away your legal rights as a consumer. If any part of these terms turns out to be unenforceable, the rest still applies.
Changes to these terms
I may update these terms from time to time. The version that applies to your order is the one shown here when you placed it.
Law and disputes
These terms are governed by Scots law, and the Scottish courts have jurisdiction. If you live elsewhere in the UK, you can still bring proceedings in the courts where you live, and rely on the consumer protections that apply there.
If something goes wrong, please contact me first. Most things are easily sorted between two people. If we can't resolve it, you can get free, impartial advice from Citizens Advice, or from Advice Direct Scotland if you live in Scotland.
